Frequently asked questions about mandatory digital clock-ins

  • End of 2024: the regulation detailing the technical and legal requirements of the digital clock-in system will be approved.
  • During 2025: the use of digital time tracking will become mandatory for all companies.

The aim of this regulation is to guarantee greater labour transparency, prevent fraud and ensure reliable tracking of hours worked.

All companies operating in Spain, regardless of size or sector, will have to implement a digital time-tracking system. The regulation applies generally and does not provide exceptions based on activity or number of employees.

Manual systems don't guarantee the security or traceability the regulation requires:

  • Easy to tamper with: data changes leave no trace.
  • Lack of legal validity: they don't meet automation requirements.
  • No real-time access: the Labour Inspectorate can't verify them immediately.
  • Risk of loss: physical documents deteriorate or go missing.

Once the regulation is in force, only certified digital systems will be valid.

  • Minor infringements: fines between €60 and €625.
  • Serious infringements: fines between €626 and €6,250.
  • Very serious infringements: fines of up to €10,000 per affected employee.

In addition, if part-time employees' working time isn't recorded correctly, the law will presume they work full-time.
